General Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all contracts between UniFash GmbH and participants concerning online continuing education programs, digital courses, supervised e-learning offers and other digital educational services.

Deviating terms and conditions of participants shall not apply unless UniFash GmbH has expressly agreed to their validity in writing.

2. Conclusion of Contract

The contract is concluded as soon as the participant signs and returns the participant contract provided by UniFash GmbH and UniFash GmbH accepts it.

The documented time of signature, return, digital transmission or acceptance by UniFash GmbH shall be decisive for the conclusion of the contract.

3. Subject Matter of the Contract

UniFash GmbH offers online continuing education programs in the fields of fashion design, pattern making, bespoke tailoring, fashion craft education and digital fashion education.

The teaching takes place digitally, with supervision, and through the online systems, learning platforms, cloud structures and communication channels provided by UniFash.

4. Digital Content and Digital Services

Digital content and digital services include in particular:

• access to the online learning platform
• Nextcloud access and digital course folders
• videos, PDF materials, scripts, worksheets and assignments
• additional assignments, project documents and digital course structures
• upload options for participant work
• digital supervision, feedback processes and communication services
• technical setup, participant administration and course activation

5. Start Before Expiry of the Withdrawal Period

If the participant wishes to start the course or receive activation before expiry of the statutory withdrawal period, express consent is required.

Before activation, the participant must actively confirm:

• that UniFash may begin providing the service before expiry of the withdrawal period,
• that digital content and course modules may be provided immediately,
• that, in the event of a later withdrawal, compensation for value may be due for services already provided,
• that the cancellation policy and the model withdrawal form have been received.

6. Right of Withdrawal for Consumers

Consumers generally have the statutory right of withdrawal. Details are set out in the separate cancellation policy of UniFash GmbH.

The cancellation policy and the model withdrawal form shall be made available to the participant before conclusion of the contract or as part of the conclusion of the contract.

7. Compensation for Value in the Case of Digital Services Already Started

If the participant expressly requests that UniFash begin providing the service before expiry of the withdrawal period and the participant later withdraws from the contract, UniFash may demand compensation for value for services already provided in accordance with statutory provisions.

Compensation for value may include in particular the following services:

• course modules already activated
• learning materials and assignments already provided
• access to digital course structures
• technical setup and platform provision
• administrative processing and participant administration
• supervision, communication or feedback services already provided

8. Special Prices, Discounts and Reduced Participation Fees

Granted special prices, discounts or reduced participation fees generally apply to the complete implementation of the agreed course.

In the event of early termination, withdrawal after the start of performance or other premature termination, the economic value of services already provided may be taken into account proportionally on the basis of the regular or agreed course value.

9. Self-Paying Participants and Funding

In the case of self-payer contracts, participation takes place independently of approval by the Federal Employment Agency, the Jobcenter or other funding bodies.

Non-approval of unemployment benefits, citizen's benefit, education voucher or other funding does not constitute an automatic special right of termination and does not create an automatic claim to rescission of the contract.

10. Use, Logging and Evidence

For the implementation, documentation and quality assurance of the continuing education program, UniFash may store usage data to the extent permitted by law.

This may include in particular:

• time of activation
• login times
• access to course folders and course modules
• upload times
• communication and feedback histories
• technical confirmations and declarations of consent

11. Obligations of Participants

Participants undertake to use the course content provided solely for their own learning purposes. Disclosure, publication, reproduction or commercial use without the written consent of UniFash GmbH is prohibited.

12. Copyright

All course content, videos, scripts, assignments, methods, documents, designs and digital materials are protected by copyright. All rights remain with UniFash GmbH or the respective rights holders.

13. Liability

UniFash GmbH shall be liable without limitation in cases of intent, gross negligence and for damages arising from injury to life, body or health.

In cases of slight negligence, UniFash GmbH shall be liable only in the event of a breach of essential contractual obligations and limited to the foreseeable damage typical for this type of contract.

14. Final Provisions

The law of the Federal Republic of Germany shall apply. For consumers, the statutory place of jurisdiction applies. For entrepreneurs, the place of jurisdiction shall be Würzburg, to the extent legally permissible.

Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
